(Adnkronos) - Maternità surrogata, anche chi va all'estero compie un reato. A deciderlo l'Aula del Senato, che ha approvato in via definitiva il ddl n. 824 sulla gestazione per altri, già votato dalla Camera. Â
La norma vieta quindi agli italiani di praticare la maternità surrogata non solo nel nostro Paese, dove è già illegale, ma anche all'estero nei Paesi dove invece la pratica è possibile. A votare a favore le forze di maggioranza, Fdi, Fi e Lega, no invece dalle opposizioni. I sì sono stati 84, i no 58.Â
"Con l'approvazione definitiva di oggi al Senato, il ddl che rende l'utero in affitto reato universale è finalmente legge. Una norma di buonsenso contro la mercificazione del corpo femminile e dei bambini. La vita umana non ha prezzo e non è merce di scambio", il commento su X della premier Giorgia Meloni.Â
Ed è scontro frontale sulla norma. Il voto che porta alla nuova legge, arriva dopo una giornata in Senato dove non sono mancati i momenti di tensione, tra maggioranza e opposizione. Con l'Aula più volte richiamata all'ordine dai presidenti di turno, visti i continui battibecchi tra chi era a favore del testo, presentato alla Camera dalla meloniana Carolina Varchi, e i contrari. Più volte i presidenti di turno, come capitato a Mariolina Castellone, hanno minacciato di sospendere l'Aula, per le continue interruzioni degli interventi, visti i continui battibecchi tra i senatori. Â
Così come successo mentre parlava la senatrice del M5S, Elisa Pirro. "I colleghi maschi di maggioranza stanno dicendo che l'utero non è il mio? I miei organi sono miei e ne faccio quello che voglio", ha detto mentre dai banchi della maggioranza non sono mancate parole di dissenso, che hanno più volte interrotto la pentastellata. "Siamo al comunismo degli organi -replicava lei- . Io posso dare il rene, ma non posso prestare il mio utero, da donna libera, italiana", rivolta al senatore di Fdi, Luca De Carlo. "I miei organi sono miei e ne faccio quello che voglio", insiste mentre viene contestata dai banchi della maggioranza. Tra un botta e risposta e un altro l'Aula vota le questioni pregiudiziali, che erano tre, tutte respinte con 87 voti contrari. Â
Poi si torna a discutere. Per il senatore della Lega, Massimiliano Romeo siamo di fronte a "ricchi committenti che pagano le donne per soddisfare il proprio desiderio, soprattuto immigrate, questo sì che è un ritorno al Medioevo". "Dove sono le femministe, dov'è la sinistra? -si domanda il capogruppo della Lega, mentre dai banchi della sinistra non mancano brusii- . Come è possibile che il diritto della donna non venga tutelato nella sua dignità ?. Adesso difendete solo i diritti dei ricchi committenti...". Â
Dal M5S replica Alessandra Maiorino: "Con questo obbrobrio giuridico equiparate la surrogazione di maternità , che già in Italia è reato, a reati universali come i crimini di guerra, la tortura, la pirateria e il genocidio, ma allo stesso tempo prevedete una punibilità pressoché bagatellare. Questo dimostra come la vostra sia una volgare speculazione per realizzare uno spot di pura propaganda sulla pelle delle bambine e dei bambini, che nascono come tutti gli altri bambini per via di un progetto d'amore e di famiglia. Tutto questo mette a nudo la vostra cattiva coscienza", attacca. Â
Dal Pd Anna Rossomando critica lo stesso concetto di reato universale: "Oggi non stiamo discutendo dell’introduzione di un ennesimo reato, considerato che in Italia è già previsto, ma di rendere universale il reato di Gpa" una norma "viziata dall’irragionevolezza e totalmente disallineata rispetto alle pronunce della Corte Costituzionale, della Corte Europea dei diritti dell'uomo e della Corte di Cassazione sezioni unite civili". Â
Per il meloniano Gianni Berrino invece "il legame che si instaura durante la gravidanza tra madre e figlio non abbraccia aspetti esclusivamente emozionali, ma ha un fondamento scientifico". Per cui "i sostenitori della maternità surrogata dimostrano di ignorare o di calpestare il fenomeno chiamato microchimerismo fetale, per mezzo del quale le cellule del feto migrano nel sangue materno, negli organi e nel cervello", dice anche lui tra le proteste dell'opposizione. Â
Il dem Filippo Sensi ha poi rivendicato la sua posizione da cattolico: "Io invece sogno di essere non un cattolico ma per la Gpa, bensì un cattolico e dunque per la Gpa, perché al cuore del messaggio cristiano c’è solo l’amore. Ci vuole forza per fare ciò che è giusto. Spero ne siate consapevoli". Â
"In Italia la gestazione per altri è già proibita. Questa è una legge propagandistica, che non verrà mai applicata. Solo una condotta percepita come gravissima in tutto il mondo può assurgere a reato universale, non una condotta lecita e prevista dalla legge di moltissimi Paesi", accusa la presidente del Gruppo per le Autonomie, Julia Unterberger. Â
