(Adnkronos) - A quanto apprende l'Adnkronos, il Viminale ha dato mandato all'avvocatura dello Stato di preparare i ricorsi contro la sentenza del Tribunale di Roma che ha bocciato il trattenimento dei 12 migranti in Albania, trasferiti in Italia sabato scorso dopo la mancata convalida. Â
Ieri il Consiglio dei ministri a Palazzo Chigi ha dato via libera al dl sui Paesi sicuri che mira a 'blindare' gli hotspot in Albania. La misura 'trasla' l'elenco dei Paesi considerati sicuri dal decreto interministeriale a un decreto ad hoc, con l'obiettivo di renderlo norma primaria.Â
L'ordinanza "è errata e ingiusta", quanto scrive il Viminale in uno dei ricorsi presentati in Cassazione contro la decisione dei giudici del Tribunale di Roma. Secondo quanto si legge nel ricorso relativo a un cittadino proveniente dal Bangladesh, "l'ordinanza deve essere cassata non solo per essersi fondata su una ricostruzione normativa errata ma anche per aver completamente omesso di indicare le ragioni in fatto che hanno condotto il Tribunale ad affermare, sulla base di detta ricostruzione, il Paese di origine dell'odierno intimato non fosse sicuro per quest'ultimo in relazione ai motivi riportati nella scheda Paese allegata al decreto Maeci del 7.5.2024 e non potesse quindi trovare applicazione la disciplina della procedura accelerata alla frontiera o nelle zone di transito"Â
E' stato rivisto l’elenco dei Paesi sicuri, "recependo le indicazioni della recente sentenza della Corte di Giustizia Ue". In particolare, sono stati rimossi i Paesi rispetto ai quali erano previste “eccezioni di carattere territoriale” (Camerun, Colombia e Nigeria). Il nuovo elenco è ora contenuto in un provvedimento con forza e valore di legge per evitare possibili disapplicazioni fondate su interpretazioni della “Direttiva Accoglienza” (la quale, tra l’altro, non appare “dettagliata e incondizionata”, rimettendo il suo recepimento ai singoli Stati membri).Â
L’elenco è ora composto da 19 Paesi sicuri, individuati secondo i criteri stabiliti dalla normativa europea (vedi l’art. 2bis del decreto legislativo 25/2008) e dai riscontri rinvenibili dalle fonti di informazione fornite dalle organizzazioni internazionali competenti. Si tratta di Albania, Algeria, Bangladesh, Bosnia-Erzegovina, Capo Verde, Costa d'Avorio, Egitto, Gambia, Georgia, Ghana, Kosovo, Macedonia del Nord, Marocco, Montenegro, PerĂą, Senegal, Serbia, Sri Lanka e Tunisia. L’elenco dei Paesi sicuri verrĂ aggiornato periodicamente, sempre mediante atto avente forza di legge.Â
I giudici del Tribunale di Roma, competente sulle procedure del protocollo Italia-Albania, hanno inviato alla Cassazione un quesito pregiudiziale a luglio scorso, ancora prima della sentenza della Corte Ue di Lussemburgo del 4 ottobre scorso. Secondo il Messaggero, la pronuncia della Cassazione è attesa per prossimo 4 dicembre e dovrĂ decidere se i giudici dei Tribunali possono mantenere una certa discrezionalitĂ nella denominazione di Paese sicuro o dovranno semplicemente attenersi alla lista del governo. Â
